Solved ANIME REVIEW: ERASED illegal copyright claim

I have a little problem. My video "ANIME REVIEW: ERASED [German/Deutsch]" Link:

was copyright claimed from the network SquaredPoints, first it's is okay when they are the copyright holder but the material is NOT from this network. SquaredPoints is a f*** SPORTS Network.
The copyright holder of the anime is KADOKAWA in japan respectively peppermint anime here in germany. The other copyright holders are: Crunchyroll, Aniplex of America Inc., Anime Limited (UK) and Anime Consortium Japan Inc.

So SquaredPoints definitely do not have the copyright. I have contacted SquarePoints and got no answer, my objection of the claim (YouTube System thing) is declined by SquarePoints itself.

I am very angry, it is not because the copyright claim. When KADOKAWA or Aniplex it was, it is okay. They have the copyright, they make this animation movie, they have the rights to cliam it. But not SquaredPoints. they have nothing to do with this.

PS.: I am not the only one with the problem, the YouTuber "Mann of a Thousand Thoughts" had the same problem witn SquaredPoints, see here:

Firstly, there is no way for you to know whether or not SquaredPoints owns the rights for this. Secondly, if they have rejected your Appeal all you can do is wait for an answer from them as a Counter-Notice is not an option here. If they do not reply and have rejected the claim the only legal way to get this lifted is legally.

What I would recommend in your case is to contact them using their contact Email at https://peppermint-anime.de/index.php/kontakt/ asking whether or not they know about this company having permission to use said content. If they do have to take the claim.
TL;DR: If they don't own it and have rejected the dispute it shows they do own the content and if they don't that is illegal but can only be solved through a court case which you should get the actual Content Owner into as well. To me it sounds like the claims are just handled by SquaredPoints on behalf of KADOKAWA or Aniplex, which is often done by content Owners who don't want to fully concentrate towards claiming on YouTube which is why they give their samples to companies that do that.

Des weiteren, wenn sie den Appeal zurückgewiesen haben kannst Du nur auf eine Antwort von ihnen warten, da eine Counter-Notice hier keine Option darstellt. Sollten sie nicht innerhalb eines angemessenen Zeitraums antworten und sie die Rechte für das audiovisuelle Material nicht besitzen, ist die einzige Methode, dies entfernt zu bekommen, durch einen gerichtlichen Prozess.

Was ich in diesem Fall empfehlen würde, wäre, die Kontakt-Email von Peppermint Anime ( https://peppermint-anime.de/index.php/kontakt/ ) anzuschreiben, ob sie davon wissen, dass SquaredPoints Rechte für das Material besitzt. Sollten sie davon wissen, dass SquaredPoints Rechte besitzt, musst Du den Claim einfach annehmen, es sei denn Du hast explizite Erlaubnis einer Firma welche Rechte dazu besitzt, dies zu verwenden.

Kurz: Sollte SquaredPoints das Material und Rechte dazu nicht besitzen, haben sie sich technisch gesehen damit strafbar gemacht, den Appeal abzuweisen allerdings kann dies, wie gesagt, nur gerichtlich entschieden werden. Ich glaube SquaredPoints hat nur die Aufgabe von KADOKAWA oder Aniplex erhalten, YouTube Content ID für Videomaterial zu verwenden und zu administrieren, was sehr häufig auf YouTube der Fall ist.

Das stimmt nicht so ganz. Ich betreibe zwar den Kanal und bekomme die Rezensionsexemplare, doch rechtlich gesehen bin ich eine Einzelperson. Zumal rechtliche Schritte in der Anime-Szene nie wirklich passiert sind in Deutschland. Eine Pflicht die Claims zu beenden sehe ich bei Publishern auch nicht, zumal das Konstrukt, einfach zu verwirrend ist, selbst für die Publisher selbst. Es wäre nur schön, wenn SuqaredPoints auch auf E-Mails reagieren würde und erklären würde wieso sie das claimen. Dann wäre das ganze viel einfacher... Nun, wenn noch mehr Probleme haben, müsste man was dagegen machen.
